An appeal has been made with the Board of Adjustment of the City of Nevada, Iowa, by Gary Clem to allow his new fence to have finished side facing inward to the property of 69 Lincoln Highway., legally described as:
Lots Seven (7) and Eight (8) in West Park Addition to Nevada, Iowa AND Parcel “A”, a part of Lots Eleven (11) and Twelve (12) in West Park Addition to nevada, Iowa, Story County, Iowa, as shown on the “Plat of Survey” filed in the office of the Recorder of Story County, Iowa, on January 15, 1997, as Inst. No-97-00451, Book 14, Page 140.
The building official was required, under the provisions of the Zoning Ordinance, to deny the building permit because the proposed construction did not comply in all respects with the terms of the Chapter 165 (Land Development-zoning regulations, specifically 165.17 (Supplemental site development regulations [7(D): Facing: The finished surface of any fence shall face toward adjacent properties and street frontage] ).
Pursuant to Section 121.1209, Code of Ordinances of Nevada, Iowa, 2003, the Board of Adjustment, after public hearing, may permit exceptions to the district regulations to authorize the proposed construction.
A public hearing will be held by the Board of Adjustment on the 13th Day of October, 2026, at 10:00 o’clock A.M., in the City Council Chambers in City Hall at 1209 6th Street, at which time you may submit your views on the matter in person, in writing, or by representative.
If you know of any interested property owner who, for any reason, has not received a copy of this Notice, it would be greatly appreciated if you would inform them of the time and place of the hearing.
